Legal provisions concerning the use of the website 

The following special conditions are applicable for access to all Internet pages and subpages on the website “www.Soignez-moi.ch”.

1. General

Declaration of understanding and agreement to the terms of use

By accessing the website www.Soignez-moi.ch and by opening the Internet pages of Soignez-moi.ch and all their subpages (hereinafter referred to, as a whole, “web pages”), you declare that you have understood the special conditions which govern access to this website (hereinafter referred to as “conditions”) and agree to them. If you do not agree to the conditions mentioned hereinafter, please stop using these web pages.

Scope of application

In principle, any person can visit the website without having to provide any personal details. The web server only records usage data in the form of log files, which provide information regarding the IP address, the last page visited, the browser used, the date and time of the visit as well as the file requested. This data is only used internally and provides information as to how to improve our services. Such usage data will not be combined with any personal data provided.

Use of the platform (i.e. consultation service) is managed by its own special conditions.  The Soignez-moi.ch web pages aim to provide information about Soignez-moi.ch as well as its products and services.

Faculty of discernment

Individuals who benefit responsibly from medical services should be capable of discernment. Faculty of discernment means the ability to act reasonably on a particular topic. Teenagers are capable of discernment regarding medical topics to the extent that unusual decisions must be made on an exceptional basis. When the patient makes a commitment (this is particularly relevant when assuming the costs), the ability to exercise their rights is therefore necessary. Any person over the age of 18 is capable of exercising their rights. If the person concerned doesn’t have the faculty of discernment or the ability to exercise their rights, consent from the legal representative (parents) is necessary for all important decisions.

2. Copyright and intellectual property rights

The content of all the web pages is protected by copyright. Any modification of the web pages or a part of them is forbidden. Any reproduction of the web pages, as well as their use for public and/or marketing purposes, is also prohibited without prior written consent by Soignez-moi.ch. Any violation of these bans will lead to legal proceedings by Soignez-moi.ch.

The name of Soignez-moi.ch, its logo and its other brands (such as PflegeMi.ch, Curami.ch) are all protected brands of Soignez-moi.ch, Laupenstrasse 11, 3176 Neuenegg. The use of these web pages does not confer any licence or right to use a picture, brand and/or logo.

Downloading and/or copying (or other similar operations) all or part of the web pages does not give you any right to the software and/or the other elements which make up the web pages in question. Soignez-moi.ch asserts all of its rights concerning the elements which make up those web pages (in particular copyright and trademarks).

3. Completeness of the web pages

Soignez-moi.ch ensures that the information to be published on its web pages is checked thoroughly at the time of publication. Considering the public nature of the Internet, neither Soignez-moi.ch nor any of its contractual partners will give assurances or guarantees as to the up-to-date nature, comprehensiveness and correctness of the data or content (attachments) which are shared. They cannot offer assurances or guarantees as to the absence of any mistakes in the information shared or made available, the software, applications, documents, calculation results or other data either. The visual identity of the web pages is regularly adapted to the latest state-of-the-art technology and updated regarding the content.

Soignez-moi.ch declines all responsibility for any direct or indirect damage and/or consequential damage suffered due to the use of software, information, documents and/or other data extracted from the web pages of Soignez-moi.ch or which are associated with access to third party web pages via links available on the web pages of Soignez-moi.ch.  Soignez-Moi.ch can equally not be held liable in the following cases (this list is not exhaustive): transmission errors, technical problems, telephone or Internet access disruptions or network failures, illegal intrusions in the network device, virus contamination, copies and falsification of data and content, network overload, the failure to detect fraudulent information, any defects of legitimation and any intentional blockage or fortuitous electronic access by third parties.

Soignez-Moi.ch cannot be held liable (including in the case of negligence) for any damage and/or consequential damage linked to access to elements on its web pages and/or their use (or the lack of access and/or use).

Medical aspect

The content of the website can in no way replace personal medical advice or treatment. Soignez-moi.ch asks all visitors to its website to always consult a doctor in the case of emergency due to medical problems.  It is also recommended that you never start, change or interrupt treatment based on individual decision and without the advice of a doctor.

The content of the website cannot automatically suggest a diagnosis or select treatment methods. Soignez-moi.ch cannot be held liable, directly or indirectly, for any damage to health or health problems linked to the use or misuse of information provided.

5. Links to other websites

Soignez-moi.ch doesn’t check third party websites that are linked to its own pages and is not responsible for their content. Following links to other Internet pages is carried out at your own risk.

6. Data security and sharing

Please be aware that the Internet is accessible to the public. Voluntary communication of personal details via the Internet is carried out at your own risk. In particular during data exchange or Internet page requests, your data may be lost and/or fall into the hands of unauthorised individuals. Soignez-moi.ch takes appropriate measures to prevent illegal handling of your personal data. However, Soignez-moi.ch cannot be held liable, especially legally, if the user does not respect the general measures for security and sharing of data, and notably those mentioned in the current section 6.

Soignez-moi.ch recommends avoiding any sharing of confidential information via electronic means and/or legally protected information. Persons who contact Soignez-moi.ch by e-mail authorise Soignez-moi.ch to contact them directly by e-mail.

Soignez-moi.ch has taken organisational and technical measures to ensure data protection and security and is committed to respecting Swiss legislation on data protection.

Soignez-moi.ch includes numerous social media plug-ins on its web pages (especially those who offer the following social media services: Facebook, YouTube, LinkedIn, Twitter and Instagram). The social networks are identifiable thanks to their logos and/or their own terms. The distinctive signs related to the network services are protected brands which do not belong to Soignez-moi.ch. The use of social media plug-ins is carried out at your own responsibility.

All of the information and data, the use thereof and recording in the Internet pages as well as any action, acceptance or omissions related to these pages is subject to Swiss law, excluding any potential conflicts of law. In the case of disputes linked to the use of the Internet pages of Soignez-moi.ch or regarding these conditions, the place of jurisdiction will be Switzerland only.

Soignez-moi.ch reserves the right to effect changes or additions to the information or data shared, at any time and without prior notification.
